The following General Terms & Conditions of Reservation are valid between SNOWELL International AG (hereafter called “SNOWELL”) and the customer (hereafter called “customer”). They are exclusively limited to the Reservation/Booking (hereafter called “Reservation”) for winter sports equipment (hereafter called “rental equipment”) and additional products (e.g. ski lockers) over the website www.snowell.com (hereafter called “internet”).
SNOWELL operates an internet-based reservation system for the advanced booking of winter sport equipment as well as additional products. SNOWELL uses an encrypted connection “SSL” (Secure Socket Layer) which creates a secure connection between the customer’s internet browser and the SNOWELL reservation system. This reservation system includes the presentation and availability of rental equipment and additional products of SNOWELL ski rental-shop partners. After completion of the booking and payment process SNOWELLsees to it that the customer receives a document (voucher) which he can use in the ski rental shop to obtain the products reserved and sees to it that the customer’s reservation information is forwarded to the chosen ski rental shop.
Promptly after each completed reservation, SNOWELL sends the customer the link to his reservation via e-mail to the e-mail address provided during the reservation. Using this link, the customer can print the voucher, the contact details of the ski rental shop, a map of the area and the shop’s opening hours.
The ski rental shop is committed to accepting all reservations and to providing the customer with the rental equipment and additional products which the customer has booked. The actual contract comes exclusively into effect between the customer and the respective ski rental shop and begins with the collecting of the rental equipment, and usage of the additional products respectively.
The rental equipment is arranged in various categories (stars) and age groups (children, youth, and adults). The actual choice of brands and models of ski and snowboard equipment takes place on location at the ski rental shop itself. The additional details per person (age, height, shoe size, weight, skiing skills, head circumference) given when choosing the rental equipment are not binding. They are solely provided to give the ski rental shop information to help with organising the availability of the rental equipment.
Prices include all those known taxes and fees applicable at the time of booking. Prices can be shown in CHF and in EUR as required and can also be paid in this way. Price differences between the ski rental shop and SNOWELL can occur due to late notification or due to false notification. Such differences do not lie within the influence or liability of SNOWELL.
SNOWELL has special offers for families such as “children up to 10 years rent free” and “free helmet for children and teenagers”. These offers are individual and listed at each ski rental shop. The following offers apply:
The child-free-offer is NOT valid with rental of all kinds of boots, toboggans, safety equipment and rental of ski lockers/ski depot.
All booked children up to and including 14 years of age (in France + Andorra up to and including 13 years of age) receive a free helmet for the rental period!
In addition to the prices given, SNOWELL calculates a booking fee between EUR 1.00 and EUR 3.00 and between CHF 2.00 and CHF 5.00 respectively. The scaling is dependent on the number of booked rental days. The booking fee is independent of the number of persons and, rather, is valid per reservation/booking.EUR 1.00 / CHF 2.00 for a booking with 1-2 rental days
7.1. SNOWELL offers the customer the possibility of paying by bank transfer to a SNOWELL account. This payment possibility only appears when reservations are completed at least 7 days before the first rental date. After the reservation, the customer receives a link to print out the invoice, which includes bank details, per e-mail. As soon as the complete payment has been received by SNOWELL, SNOWELL sends the customer a link per e-mail to print out the customer’s voucher.
7.2. Further, the final price for the reservation can be paid by VISA, Mastercard, V Pay, Masterpass, Carte Bleu, iDeal, Bancontact, Klarna (former Sofortüberweisung) or Postfinance. The processing of the payment takes place via an external provider (SIX Card Solutions AG/Saferpay). SNOWELL is a PCI DSS certified company and therefore does not record any payment details. Upon payment according to section 6.2., the customer receives via e-mail a link to print out the voucher.
In the case of subsequent bookings or refunds, SNOWELL is authorised, in agreement with the customer, to credit or charge any resulting differences which occur to the customer’s credit card account.
By using the coupons of SNOWELL, the coupon holder accepts the following general and additional coupon terms and conditions, whereby, in addition to these terms and conditions, the general reservation terms and conditions of SNOWELL International AG apply.8.1. General terms and conditions
Upon completion of the reservation, the customer confirms the correctness of his/her reservation and all the information contained therein. The reservation is acknowledged as accepted by SNOWELL, as soon as SNOWELL has sent the e-mail with the link for printing the invoice or voucher to the customer.
Thereafter, the customer is obliged to check the information shown in the internet as well as the details on the invoice, or voucher respectively which he/she receives e-mail for their correctness. Discrepancies to the reservation are to be communicated to SNOWELL immediately. When there are no differences, the reservation also obtains its validity for the customer. The customer has exclusively to present and submit the voucher in the ski rental shop in order to obtain the booked services.
The customer can change the reservation up to 3 days before collecting the rental equipment or using the additional products without incurring any additional charges. The changes are to be given to SNOWELL either in writing or by telephone.
Cancellation of a reservation must be notified in writing to SNOWELL at least 1 day before the start of the rental period. SNOWELL charges a fee of EUR 25.00 per person for the cancellation of a reservation. The difference between the already made payment and the cancellation fee shall be promptly returned to the customer.
SNOWELL recommends the taking out of a cancellation guarantee which is the equivalent of 5% of the rental price at the same time as reservation. This covers the cancellation fees in the event of such a cancellation. In the case the guarantee is exercised, this amount shall be kept by SNOWELL. The full rental price and the booking fee (100%) shall be promptly returned to the customer.
Unfavourable weather and other hindrances beyond SNOWELL’s control do not qualify as reasons for cancellation. SNOWELL cannot provide a refund if the booked rental equipment is, for whatever reason, not collected, collected at a later date or returned earlier than was planned.
If the cancellation occurs on the first day of the rental period or thereafter, cancellation costs of 100% of the booked equipment or service will be charged. In case of illness or accident of the customer during the rental period, a partial refund of the rental price can only be made if the following requirements are met:
Following this, the customer will receive a pro rata refund of the paid rental price. If the child-free-offer has been used in the booking, the child-free-offer will be void or payable in case of subsequent changes to the rental period of the adult equipment (see point 5).
The collection of the rental equipment is done by the customer on the first rental day from the ski rental shop detailed on the voucher. At the customer’s request, the rental equipment can be collected after 4:00 p.m. on the day before the first rental day, in France and Andorra from 5:00 p.m. (except night skiing). Upon collection, the customer is to present official identification (e.g. passport, identity card or driver’s licence) as well as his/her voucher and declares his/her consent that copies of these documents can be made.
The return of the rental equipment is to take place on the last day of the rental period before the ski rental shop closes. The customer is responsible for informing himself/herself about the shop’s closing times. In the case that the rental equipment is used for a period longer than that reserved and paid for, respectively, then the difference shall be calculated according to the local prices and conditions. This difference is to be paid directly in the ski rental shop.
The exchange of rental equipment in the sports shop during the rental period to a higher category as well as a change from skis to snowboards or vice versa is possible in most sports shops. Applicable are the relevant rental terms and conditions of the individual sports shop. No refund/reduction in price can be given for an exchange to a lower category of equipment.
An insurance against third party liability, breakage, faulty equipment, theft, etc. is NOT included in the rental price. The customer is responsible for this. SNOWELL explicitly excludes all insurances. The local rental terms and conditions of the relevant sports shop apply with regard to insurance.
SNOWELL is only liable for damages which affect the actual reservation process. SNOWELL sees itself purely as a central processing point for reservations. Since no rental agreement comes into effect between SNOWELL and the customer and SNOWELL is not assigned the task of fulfilling the rental agreement, nor is SNOWELL able to exert any influence upon it, no liability claims can be made against SNOWELL which result from theft, breakage, accidents, etc. Such claims are to be exclusively made against the relevant ski rental shop. Any liability for ordinary negligence is excluded.
The language for negotiations in the case of litigation is German. All translations into other languages fulfil our intention to provide our customers with information. The contractually binding version is in German.
It is exclusively agreed that Liechtenstein law is applicable to all litigation in connection with or in relation to reservations via www.snowell.com. The court of jurisdiction is Vaduz.SNOWELL International AG, December 2017
